Herefordshire Council has refused the planning application to build 73 dwellings on land at Kings Acre Halt. In brief the reasons are: –

1. The proposed point of vehicular access onto the A480 falls within the national speed limit (60 mph) but is incorrectly identified as being subject to a 40 mph restriction in the submitted Transport Assessment. The proposed access also lies opposite the entrance to the Wyevale Business Park. The Council considers that the potential conflict between emerging vehicles at this location would increase the likelihood of accidents to the extent that the residual cumulative impacts of the development should be considered severe.

2. With regard to the National Planning Policy Framework and National Planning Practice Guidance the Council considers that the proposals have the effect of potentially fundamentally conflicting with proposals for the Western Relief Road, which are central to meeting the long-term housing delivery requirements of the emerging Local Plan.

3. A legal agreement pursuant to SI06 of The Town and Country Planning Act 1990 (As Amended) has not been completed.
